1. About us
This website, anniessweets.co.uk, is run by Annie's Sweets & Treats Ltd, trading as Annie's Sweets and Treats ("we", "us", "our"). We are a company registered in England and Wales under company number 16171705. Our registered office is 25 Greengate, Preston, Lancashire, PR4 5FH, United Kingdom.
You can contact us by email at annieprimrose@me.com, by phone on 01772 614200, or through our contact page.
2. These terms
These terms apply to any order you place on our website and to your use of the website. Please read them before you order. By placing an order you agree to these terms.
These terms are written for consumers buying for personal use. If you are buying for a business, see section 13.
Nothing in these terms affects your legal rights as a consumer, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
3. Our products
- Product images are for illustration, and packaging designs may vary slightly from those shown.
- We never swap named-brand items (for example Hershey's, Reese's or Kinder).
- The only exception is dark chocolate and vegan chocolate bars, which may vary depending on availability. If an advertised dark or vegan chocolate bar is unavailable, we will replace it with a bar of the same style: dark chocolate for dark chocolate, and vegan chocolate for vegan chocolate. Vegan and gluten-free products will only ever receive vegan or gluten-free replacements. If you need a specific bar, for example because of an allergy, please tell us in your order notes or contact us before ordering.
- Apart from this, we never substitute an item without your agreement. If anything else in your order is unavailable, we will contact you to agree a replacement, or refund you for that item if you prefer.
- Some items, such as clothing, mugs and other merchandise, are printed to order by our print partner and are sent separately from food orders.
4. Allergens and dietary information
Allergen and ingredient information is shown on each product page and on the product labels. Always check the label before eating. Our products are packed by hand alongside products that contain common allergens (such as peanuts, milk, gluten and soya), so we cannot guarantee any product is free from traces of allergens, even where it is labelled vegan or gluten-free. If you have a severe allergy or any question about ingredients, please contact us before ordering.
5. S'mores burners and fuel
Some kits include a burner, chafing fuel or skewers. These must only be used by adults or under close adult supervision, outdoors or in a well-ventilated area, on a stable, heat-resistant surface, away from anything flammable. Never leave a lit burner unattended, never refill or move it while lit or hot, and follow the instructions supplied. Keep fuel out of reach of children.
6. Placing an order and when the contract is formed
When you place an order you will receive an email acknowledging it. This does not mean we have accepted your order. The contract between us is formed when we email you to confirm your order has been dispatched.
We may decline an order, for example if an item is out of stock, if we cannot deliver to your address, or if there is an obvious pricing error. If we do, we will tell you and refund any payment in full.
7. Prices and payment
- Prices are shown in pounds sterling. We are not VAT registered, so no VAT is charged. Any delivery charge is shown at checkout before you pay.
- We take care to price items correctly. If we find an obvious error in the price of something you have ordered, we will contact you and you may either proceed at the correct price or cancel for a full refund.
- Payment is taken when you place your order.
8. Delivery
- We deliver to addresses in the United Kingdom. Delivery options, charges and estimated delivery times are shown at checkout and in our Shipping Policy.
- Orders are dispatched within 1 working day (Monday to Friday, excluding bank holidays) by Royal Mail Tracked 24. Please allow up to 2 working days for delivery after dispatch. Printed merchandise takes longer, as it is made to order.
- If we cannot deliver within 30 days of the contract being formed, or any delivery date we have agreed with you, you may cancel and receive a full refund.
- The products are your responsibility once they have been delivered to the address you gave us, or collected by you or someone you nominate. Please make sure someone can receive the parcel or that it will fit through your letterbox where described as letterbox-friendly.
9. Your right to cancel
For most products you have the right to cancel your order within 14 days, starting the day after you receive the goods, without giving a reason. To cancel, email us at annieprimrose@me.com with your order number. You must then return the goods within 14 days of telling us, unused and in their original condition. Unless the goods are damaged, faulty or not as described, you will pay the cost of returning them. Returns of damaged, faulty or incorrect items are free. We will refund you within 14 days of receiving the goods back (or evidence that you have sent them), using your original payment method.
The right to cancel does not apply to:
- food and sweets that have been opened, or whose seal or packaging has been broken;
- perishable items with a short shelf life;
- items made to your specification or clearly personalised.
This does not affect your rights if goods are faulty or not as described (see section 10). Our Refund Policy explains our returns process in more detail.
10. Faulty, damaged or incorrect items
Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality. If your order arrives damaged, faulty, incorrect or not as described, please contact us as soon as possible, ideally with a photo, and we will put it right. Depending on the problem, you may be entitled to a replacement, a repair or a refund. If you tell us within 30 days of delivery, you are entitled to a full refund. For perishable food, please let us know promptly and before the best-before date. This is a summary of your key legal rights. For detailed information, visit the Citizens Advice website or call 0808 223 1133.
11. Refunds
Refunds are made to the original payment method. We will not charge a fee for processing a refund we owe you by law. If you cancel within the 14-day period, we will refund the standard delivery charge you paid, but not any extra cost of a premium delivery option you chose.
12. Our responsibility to you
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if both of us knew it might happen when the contract was made.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products (including the right to receive products that are as described and of satisfactory quality), or for anything else that cannot be excluded or limited by law.
We supply products for domestic and private use only. We are not responsible for any loss of profit, loss of business or business interruption.
13. Business customers
If you buy as a business, sections 9 to 11 do not apply to you. Our total liability to you for any order is limited to the price you paid for it, and we will not be liable for any indirect or consequential loss. Nothing in this section limits liability that cannot be limited by law.
14. Using our website
- You must not misuse the website, including by introducing viruses or other harmful code, attempting unauthorised access, or scraping or copying content for commercial use.
- All content on this website, including text, photos, logos and designs, belongs to us or our licensors. You may not copy or reuse it without our written permission.
- If you leave a review or send us feedback, you allow us to use and display it (including on our website and social media). Reviews must be honest and lawful, and we may remove content that is offensive or misleading.
- Our website may link to third-party websites. We are not responsible for their content or practices.
- We try to keep the website accurate and available but cannot guarantee it will always be error-free or uninterrupted.
15. Your personal information
We use your personal information only as set out in our Privacy Policy.
16. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as postal disruption, severe weather or supplier failure. If this happens we will let you know, and if there is a risk of substantial delay you may cancel and receive a refund for anything you have paid for but not received.
17. Other important terms
- We may update these terms from time to time. The terms that apply to your order are those in force when you placed it.
- If a court finds part of these terms unlawful, the rest will continue in force.
- If we do not enforce any of these terms straight away, we can still enforce them later.
- No one other than you and us has any right to enforce these terms.
18. Complaints and governing law
If you have a problem or complaint, please contact us first at annieprimrose@me.com and we will do our best to resolve it quickly.
These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can bring proceedings in Scotland or England. If you live in Northern Ireland, you can bring proceedings in Northern Ireland or England.
